1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of https://aijazmagsilandscaping.com/ (the “Website”) and your interactions with Aijaz Magsi Landscaping L.L.C (“Aijaz Magsi Landscaping”, “we”, “us”, or “our”). By using the Website, submitting an enquiry, or requesting a quotation, you agree to these Terms. If you do not agree, please do not use the Website.
These Terms govern Website use and preliminary service enquiries. Any landscaping project or maintenance service may also be governed by a separate written quotation, proposal, scope of work, work order, or contract (a “Service Agreement”). If a Service Agreement conflicts with these Terms on a project-specific matter, the Service Agreement will control for that matter.
2. About Our Website and Services
The Website provides general information about landscaping, garden maintenance, hardscaping, artificial and natural grass, irrigation systems, fountains, lighting, pergolas, gazebo and wood work, tree work, cleaning, planting, and related outdoor services. Information on the Website is not a binding offer and may be changed or withdrawn without notice.
Service availability, feasibility, materials, timing, and price depend on the property, site conditions, measurements, design, access, approvals, requested specifications, and other project factors. A service is not confirmed until we issue or accept a written Service Agreement and any required deposit or other stated condition has been satisfied.
3. Eligibility and Authority
You must have the legal capacity to use the Website and enter into any Service Agreement. If you act for a company, property owner, tenant, contractor, or another person, you confirm that you have authority to provide instructions, share the relevant information, and accept applicable terms on their behalf.
4. Enquiries, Site Visits, and Quotations
You agree to provide accurate and complete information when requesting a consultation, site visit, or quotation. A preliminary estimate given by phone, message, photograph, or online form is for guidance only unless expressly stated otherwise in writing. Final pricing may require an on-site inspection, measurements, design confirmation, material selection, and assessment of access or technical conditions.
Unless a quotation states otherwise, it is valid only for the period specified in it and is based on the scope, quantities, assumptions, and exclusions stated at the time. Changes in scope, measurements, specifications, materials, site conditions, authority requirements, or customer instructions may require a revised price and schedule.
5. Service Agreements
A Service Agreement should identify the agreed scope, deliverables, materials, price, payment schedule, expected timing, exclusions, and any applicable warranty. You should review it carefully before acceptance. Work outside the agreed scope, including additional materials, repairs, access work, removal, disposal, or authority requirements, may be treated as a variation and charged separately after approval.
6. Prices, Deposits, Payments, and Taxes
Prices are stated in UAE dirhams unless otherwise indicated. VAT or other applicable taxes will be added or included as stated in the Service Agreement and as required by law. Deposits, milestone payments, final payments, accepted payment methods, and due dates will be set out in the applicable Service Agreement or invoice.
You must make payments by the stated due dates. To the extent permitted by law and the Service Agreement, we may pause scheduling, procurement, delivery, or work if an amount is overdue. You are responsible for checking payment instructions and should confirm any unexpected change to bank or payment details directly with us using a verified contact method.
7. Scheduling and Delays
Project dates and completion estimates are given in good faith but may depend on weather, plant or material availability, site access, customer decisions, authority approvals, utilities, third-party contractors, and other factors beyond our reasonable control. Unless expressly agreed in writing, dates are estimates rather than guaranteed deadlines. We will use reasonable efforts to communicate material changes to the schedule.
8. Customer Responsibilities
You are responsible for:
- providing lawful, safe, and timely access to the site, including any required access permission from an owner, landlord, community, or building management;
- providing accurate information about boundaries, utilities, underground services, drainage, structures, restrictions, and known site hazards;
- obtaining permits, approvals, and no-objection certificates unless the Service Agreement expressly assigns this responsibility to us;
- protecting or identifying valuables, fragile items, pets, children, and areas not included in the work;
- making timely selections, approvals, and payments; and
- following reasonable care, watering, maintenance, and safety instructions after completion.
We are not responsible for delay, additional cost, or damage caused by inaccurate information, hidden conditions, undisclosed utilities, unsafe access, unauthorised instructions, or failure to meet these responsibilities, except to the extent caused by our negligence or otherwise required by law.
9. Variations, Cancellation, and Rescheduling
Requests to change the scope, design, materials, quantity, schedule, or site conditions may affect price and timing and may require written approval. Cancellation and rescheduling terms, including the treatment of deposits, custom materials, plants, mobilisation, design work, or completed work, will be governed by the applicable Service Agreement and mandatory law. Contact us promptly if you need to change or cancel an appointment or project.
10. Materials, Plants, and Natural Variations
Natural materials and living plants may vary in colour, texture, size, growth, and appearance. Images, samples, renders, and portfolio photographs are illustrative and may not exactly match the final result. Plant survival and landscape performance can be affected by weather, irrigation, soil, pests, disease, maintenance, and customer care. Any replacement commitment or warranty applies only if expressly stated in the Service Agreement and subject to its conditions.
11. Inspection, Handover, and Warranties
You should inspect the work at completion or handover and notify us promptly of any concern. We will assess reported issues and, where required by the Service Agreement or applicable law, take reasonable corrective action. Except for rights and warranties that cannot lawfully be excluded, the only project-specific warranty is the warranty expressly stated in the relevant Service Agreement. Normal wear, misuse, third-party work, inadequate maintenance, unauthorised changes, extreme weather, pests, disease, utility failure, and conditions outside our reasonable control may be excluded to the extent permitted by law.
12. Acceptable Use of the Website
You may use the Website only for lawful purposes. You must not:
- attempt to gain unauthorised access to the Website, server, forms, accounts, or data;
- introduce malware, harmful code, automated scraping, excessive requests, or other activity that disrupts the Website;
- misrepresent your identity, submit false or unlawful material, or use the Website to harass or harm another person;
- copy, reproduce, republish, sell, or commercially exploit Website content without written permission; or
- use our name, branding, images, or content in a way that suggests false endorsement or affiliation.
13. Intellectual Property
The Website and its text, graphics, branding, logos, photographs, videos, designs, layout, and other content are owned by or licensed to Aijaz Magsi Landscaping and are protected by applicable intellectual-property laws. You may view and print limited Website content for personal, non-commercial use. No other right or licence is granted unless we agree in writing.
Project drawings, concepts, designs, estimates, and proposals remain subject to the ownership and usage terms stated in the applicable Service Agreement. You must not provide them to another contractor or use them for construction unless the agreed fees have been paid and the Service Agreement permits that use.
14. Information and Materials You Submit
You retain ownership of material you submit, but you give us permission to use it as reasonably necessary to respond to your enquiry, prepare a quotation, plan or perform services, maintain records, and meet legal obligations. You confirm that you have the right to provide the material and that it does not infringe another person’s rights or violate law. We will not use identifiable project photographs for public marketing without permission or another lawful basis.
15. Third-Party Links and Services
The Website may contain links to WhatsApp, maps, social networks, suppliers, or other third-party websites. We do not control and are not responsible for their content, availability, security, or practices. Your use of a third-party service is governed by that provider’s terms and policies.
16. Website Disclaimers
We aim to keep Website information accurate and available, but the Website is provided on an “as available” basis. To the extent permitted by law, we do not guarantee that the Website will always be uninterrupted, error-free, secure, current, or suitable for a particular purpose. General articles, descriptions, and images do not replace an on-site assessment or a written Service Agreement.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Aijaz Magsi Landscaping will not be liable for indirect, incidental, special, punitive, or consequential loss arising solely from Website use, including loss of opportunity, profit, data, or business interruption. For claims relating to paid services, any limitation or allocation of liability will be governed by the applicable Service Agreement and mandatory law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, gross negligence where applicable, personal injury caused by negligence, or mandatory consumer rights.
18. Indemnity
To the extent permitted by law, you agree to compensate us for reasonable losses, costs, or claims arising from your unlawful misuse of the Website, infringement of another person’s rights, or material breach of these Terms. This clause does not apply to the extent a loss was caused by our own breach, negligence, or misconduct.
19. Events Beyond Reasonable Control
Neither party will be responsible for delay or failure caused by events beyond reasonable control, such as severe weather, natural disaster, fire, flood, epidemic, government action, labour disruption, utility interruption, transport disruption, supply shortage, or failure of essential third-party systems. The affected party should notify the other where reasonably practicable and take reasonable steps to reduce the impact.
20. Privacy
Our collection and use of personal information are described in our Privacy Policy. By submitting information through the Website or another communication channel, you acknowledge that Policy.
21. Suspension or Termination of Website Access
We may restrict or suspend access to the Website where reasonably necessary to protect security, investigate misuse, comply with law, perform maintenance, or enforce these Terms. Provisions that by their nature should continue after termination will survive, including intellectual-property, disclaimer, liability, and dispute provisions.
22. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted on this page with an updated “Last updated” date. Changes apply from publication and do not change an already accepted Service Agreement unless the parties agree or the law requires otherwise.
23. General Provisions
If any provision is held invalid or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a lawful business reorganisation or transfer, provided this does not reduce mandatory rights.
24. Governing Law and Disputes
These Terms and Website use are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai. Subject to any mandatory consumer-protection or jurisdiction rules, the courts of Dubai will have jurisdiction over disputes. Before starting formal proceedings, the parties should first attempt in good faith to resolve the matter through direct communication.
